Discuss the jurisdiction and powers of the High Court.
The jurisdiction and powers of the High Court are as follows:
- Original Jurisdiction — A High Court has the authority to hear and decide cases in the first instance. Original Jurisdiction extends to following cases:
- Cases regarding wills, divorce, marriage, Contempt of Court, etc.
- It has the power to interpret the Constitution. This is known as the power of Judicial Review.
- It has the power to enforce the fundamental rights by using writs.
- Appellate Jurisdiction — Its Appellate Jurisdiction extends to both civil and criminal cases as:
- Appeals against the judgement of a Sessions Judge, an Additional Sessions Judge, Assistant Sessions Judge, the Chief Metropolitan Magistrate or Judicial Magistrate.
- A sentence of death must be confirmed by the High Court before it is carried out. Besides, it also hears appeals regarding land revenue.
